We offer software development services to businesses and individuals. Our Services may include software design, development, testing, and maintenance.
- Payment and Billing
We will provide you with a quote for our Services based on the scope of your project. Payments needs to be done upfront.
If you fail to pay for our Services in a timely manner, we reserve the right to suspend or terminate our Services to you.
- Intellectual Property
All intellectual property rights in the software we develop for you belong to you. However, we retain the right to use any general knowledge, techniques, or materials we develop or acquire during the course of our work for you in our other projects.
- Confidentiality
We will keep your project confidential, and will not disclose any information about your project to any third party without your permission. However, we may disclose your project information if required by law or if necessary to protect our legal rights.
- Warranty and Disclaimer
We warrant that our Services will be performed with reasonable skill and care. However, we do not guarantee that our Services will be error-free or uninterrupted. We are not responsible for any delays or damages caused by events beyond our reasonable control.
EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- Limitation of Liability
IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR RELATED TO OUR SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR LIABILITY TO YOU FOR ANY DIRECT DAMAGES ARISING OUT OF OR RELATED TO OUR SERVICES OR THESE TERMS WILL BE LIMITED TO THE AMOUNT YOU PAID US FOR OUR SERVICES.
- Indemnification
You agree to indemnify and hold us harmless from any third-party claim or liability arising out of or related to your use of our Services or your breach of these Terms.
- Termination
Either party may terminate these Terms at any time for any reason upon written notice to the other party. Upon termination, you will pay us for all Services we have provided to you up to the date of termination.
- Governing Law and Jurisdiction
These Terms will be governed by and construed in accordance with the Belgian laws, without giving effect to any choice of law or conflict of law provisions.
- General
These Terms constitute the entire agreement between you and Rocketbun with respect to our Services, and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. No waiver of any provision of these Terms will be deemed a further or continuing waiver of that provision or
